Litigation Law
Micah Jacobs, JD, specializes in complex business and commercial litigation, as well as complex intellectual property, technology, entertainment and securities litigation. He has over 18 years of experience litigating and trying cases in state and federal courts throughout the United States and internationally. He is an accomplished trial lawyer and has a proven track record of success for his clients. He has repeatedly been recognized by his peers and by Law and Politics as a Northern California Super Lawyer, including 2005-6, and 2010-13. In 2009, the Daily Journal named Micah among the top 75 intellectual property litigators in California, noting a seven figure settlement he obtained for a doctor in a cross-border dispute with a large pharmaceutical company headquartered in India for misappropriation of trade secrets and patented cardiac drugs.
Micah has secured many unanimous jury verdicts for both plaintiffs and defendants, as well as large settlements in prominent cases. For example, Micah secured a $23 million settlement from Homestore.com, Inc., in a widely publicized securities fraud case representing business owners who sold their company to Homestore for artificially inflated Homestore stock just before Homestore announced its “accounting irregularities” and its stock price collapsed. Going up against one of California’s largest firms, Micah convinced a Federal District Court judge to issue an order requiring Homestore to put over $50M in escrow pending the results of the litigation. The case settled shortly thereafter.
Micah has significant expertise representing plaintiffs and defendants in intellectual property litigation, including patent, copyright and trademark infringement cases as well as misappropriation of trade secrets and theft of ideas. Micah has represented leading internet and technology companies throughout Silicon Valley, as well as many other industries. He is currently trial counsel in a global IP misappropriation case against the Indian Institute of Technology/Republic of India, and has successfully defeated numerous motions including a motion for Foreign Sovereign Immunities filed by one of the world’s largest law firms defending the Republic of India. He also recently obtained a dismissal for a large internet marketing company accused of patent infringement, although the plaintiff continues to prosecute its claims against other leading companies such as Citrix, Microsoft, and Adobe.
Micah won unanimous jury verdicts in Los Angeles Superior Court representing a television and film actor suing his agent, who was also his business manager and financial advisor, for breach of contract and for failing to perform up to industry standards. These multiple verdicts were all unanimously affirmed by the California Court of Appeal.
Because of his ability to handle a company’s most critical cases through trial while maintaining a commitment to personal service and developing creative and cost-effective settlement and litigation strategies, Micah is routinely sought out by small, medium and large businesses, as well as artists, authors, inventors, entrepreneurs and start-ups, to protect their interests and resolve their important legal problems.
While his passion is to try cases, most cases can and should be resolved before trial for the best business solution. As such, Micah brings his common sense, sophisticated negotiation and creative problem solving skills to every case. Through aggressive yet focused and methodical preparation for trial, Micah is able to resolve even the most difficult disputes in the most cost-effective manner possible.
Before founding Jacobs Law Group SF, Micah spent 10 years litigating large complex disputes at several of California’s top firms, including Cooley Godward, LLP in San Francisco, Wilson, Sonsini, Goodrich & Rosati, LLP in Palo Alto and Bingham McCutchen in Los Angeles. He co-founded Jacobs & Ferraro, LLP, a successful boutique business, technology and entertainment law firm in San Francisco. After seven great years, Jacobs & Ferraro merged with a larger out of state firm that acquired it to expand its San Francisco presence. Several years later, Micah decided to return to the smaller firm platform in order to embrace his entrepreneurial spirit, and to provide more personalized, cost effective service without the administrative overhead and bureaucracy associated with larger firms.
Micah earned his law degree from the University of California, Berkeley School of Law (Boalt Hall) in 1994. He earned his Bachelor of Arts degree in Political Science/International Relations from the University of California at Los Angeles.
Micah is a member of the State Bar of California and admitted to practice before the California Supreme Court, the Ninth Circuit Court of Appeals and the Federal Circuit Court of Appeals. He is also admitted to practice before the United States District Courts for the Northern, Southern, Eastern and Central Districts of California.
Before practicing law, Micah was a ski instructor at Squaw Valley, USA, and a competitive triathlete, completing the Ironman Triathlon in 1994. He now coaches little league baseball and is the proud father of two amazing boys, ages 9 and 7.
